It is the company’s aim to provide and maintain a safe and trusted marketplace wherein clients and consultants can connect and engage in commercial arrangements. In order to facilitate this we require you as a user of the platform to agree to and abide by the terms mentioned in this SkillQuo Code of Conduct. Please also read our Privacy Policy and Terms of Service for more information. By accessing the Site or using any of the Site Services after the effective date, you agree to these Terms. You are also independently responsible for complying with all applicable laws related to your use of the Site or the Site Services whether or not covered by the Terms.
1. PROHIBITED USE
The following applies to all aspects of use of the platform including, but not limited to job postings, proposals, private messages between client/consultant, communications with the company, forum postings, profile information and feedback comments.
1.1 | You must not use, encourage, promote, facilitate or instruct or induce others to use the platform in any way that would be illegal, unlawful or contrary to any statute, ordinance or regulation. | |
1.2 | You must not use, encourage, promote, facilitate or instruct or induce others to use the platform in any way that would be considered as fraudulent, harmful or offensive. | |
1.3 | Unacceptable use of the platform includes, but is not limited to: | |
(i) | seeking, offering or endorsing illegal, obscene or pornographic services or activities. This includes requesting others to create, review or edit works that may be considered pornographic, erotic, obscene or sexually explicit; | |
(ii) | posting content that is offensive, defamatory, profane, vulgar, obscene or threatening; | |
(iii) | seeking, offering or endorsing any services that would be in violation of the company’s terms of service; | |
(iv) | seeking, offering or endorsing any services that would be violation of any contractual obligations; | |
(v) | seeking, offering or endorsing any services that violate the academic policies of any educational institution; | |
(vi) | fraudulently billing or attempting to fraudulently bill any client by any means; | |
(vii) | expressing a preference in a job post or proposal or otherwise unlawfully discriminating on the basis of race, religion, color, nationality, ancestry, physical or mental disability, medical condition, genetic information, marital status, sex, gender, identity, gender expression, age, sexual orientation, military/veteran status or any basis protected by applicable law; | |
(viii) | posting content that is defamatory, obscene or offensive; | |
(ix) | posting content that may in any way be considered as harassing towards another person or in violation of another person’s rights; | |
(x) | posting confidential or identifying information about another person; | |
(xi) | making or demanding bribes; | |
(xii) | making or demanding payments without the intention of providing or receiving the services in exchange for the payment; | |
(xiii) | spamming other users; | |
(xiv) | use of any robot, spider, scraper or other automated means to access the platform for any purpose without permission or collecting or harvesting any personally identifiable information including account names from the platform; and | |
(xv) | engaging in any conduct that is reasonably likely to or that is intended to harm the platform, including overloading the platform’s infrastructure, interfering with the proper operation of the platform, bypassing any measures in place to restrict access to certain areas of the platform and/or interfering with or compromising the integrity or security of any transmissions to or from the servers running the platform. |
2. USING THE SITE FOR ANYTHING OTHER THAN ITS INTENDED PURPOSE
When you sign up to use the platform you do so with the intention of entering into a commercial relationship with a client/company. You agree to make and receive all payments through the company’s escrow system. You agree to receive or perform freelancer services. The following are examples of prohibited use of the Site:
2.1 | You must not offer services for the sole purpose of obtaining positive feedback of any kind; |
2.2 | You must not request, demand or receive free services, including requesting freelancers to submit work as part of the proposal process for very little or no money or posting contests in which freelancers submit work with no or very little pay with only the winning submission being paid the full amount; |
2.3 | You must not request a fee before allowing another user to submit a proposal; |
2.4 | You must not post the same job multiple times so that more than one version remains active at a given time; |
2.5 | You must not withhold payment or work in exchange for obtaining positive feedback; |
2.6 | You must not attempt to falsify, manipulate or coerce another user by threatening to give negative feedback; |
2.7 | You must not misuse the feedback feature to express views unrelated to work; |
2.8 | You must not duplicate or share accounts; |
2.9 | You must not sell, trade or give your account to another person without the company’s consent; |
2.10 | You must not share or solicit contact information such as email, telephone number, Skype IDs in profiles or job posts; |
2.11 | You must not solicit or process payments outside of the company’s platform; |
2.12 | You must not advertise products or services that are outside or beyond the scope of the company’s marketplace; |
2.13 | You must not advertise on the platform to recruit freelancers to join another agency, website or company. |
3. MISLEADING CONTENT
You must not use the site to post misleading profiles, jobs, proposals or other content. This includes misrepresenting your experience or skills, impersonating another person, falsifying feedback, allowing others to operate and use your account, inferring connections and relationships with others, including the company and its representatives.
4. ENFORCEMENT
We reserve the right but assume no obligation to investigate any violation of this code of conduct. This may result in content being removed or modified and if necessary will lead to access to the platform being disabled.
Any activity that violates any law or regulation will be reported to the relevant enforcement officials, regulators or appropriate third parties. This reporting may include disclosure of user information. We have an obligation to cooperate with appropriate law enforcement agencies, regulators, and other third parties to assist with investigation and prosecution of those engaged in illegal conduct.
5. REPORTING VIOLATIONS
If you become aware of any violation to this code of conduct or the terms of service you must report it to the company. You agree to assist with any investigation we undertake and to take any remedial steps we require in order to correct a violation of these terms.
